On this fall's 2012 election ballot, you will find two Indiana Supreme Court justices: Justice Steven David and Justice Robert Rucker.
Justice Steven David struck down Indiana's Castle Doctrine law in May 2011 and gutted the 4th Amendment with his decision in Barnes vs. Indiana. The Castle Doctrine allowed citizens to defend their homes against unlawful entry. This law had stood here in Indiana for over 300 years.
Justice Rucker showed his strong support for the 4th Amendment and the Castle Doctrine, writing for the minority.
Voters are asked on the ballot if they would like to retain a judge by answering the question with a "yes" or a "no." A simple majority of "no" votes will remove a justice from the bench. A simple majority of "yes" votes will retain a justice on the bench.
